Data protection information for the Foodfittery app
Home Connect GmbH, located at Carl-Wery-Straße 34, 81739 Munich, Germany (hereinafter “Foodfittery” or “we”), is responsible for the collection, processing and use of your personal data in connection with the Foodfittery app (hereinafter “app”).
Your personal data, which is either entered by you or otherwise created and processed when you use the app, the associated household appliances, or the services offered by Foodfittery, is collected, processed and used in compliance with applicable data protection laws. The following information explains how we manage such data in accordance with the terms of use or another legal basis.
1. Types of personal data
When using the app, the associated household appliances, or the services and features offered by Foodfittery (hereinafter “Services”), Foodfittery collects, processes and uses the following categories of personal data.
a. User data and usage data
We collect and use the following personal data when setting up the app and during use:
- Data you provide when contacting us via the feedback function, which opens the local email app on your device:
- First and last name
- E-mail address
- Information we collect and store (in the app) during onboarding and use of the app:
- Language setting of your mobile device
- Agreement to and acceptance of the terms of use
- Acknowledgement of the data protection information
- User account status (if a connection to the HomeConnect app exists and is in use)
- App tracking setting
- Consent to push notifications
- Dietary preferences
- Bookmarked recipes (favourites)
- Pseudonymous analytics ID (related to the app) if “Allow app analytics” is enabled
b. App usage data
App-related usage data is data from your activities within the app, such as the app features used, click behaviour in relation to the app’s controls, choices made in drop-down menus, settings of on/off switches and error reports of the app, as well as interactions between your app and third-party applications (e.g. websites that you open from within the app).
2. Purpose of use
We use the above-mentioned category of data
- to provide the features in the app and the services offered via the app (1.a.-b.).
- to improve the usability of the app and to troubleshoot specific or general issues with the app and the digital services offered through it (1. b.).
- to improve our products and services (including those of our affiliated companies), particularly regarding unused and/or frequently used programs and other features of the app and the household appliance (including algorithmic learning) (1.b.).
The legal basis for the purposes of processing under the GDPR (REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016) is described under point 11 of this information.
3. General retention periods
Unless otherwise stipulated by law, the following general retention periods apply:
App usage data: Storage in pseudonymous form and provision in personalised form for services delivered via the app, provided “Allow app analytics” is activated. If deactivated, the individual but pseudonymous ID used for analysis is suspended. Upon reactivation, this ID is reassigned to the app.
4. Data processing management for app data
You can delete your locally stored app data by deleting the app and all locally stored user-related data will be removed.
5. Transferring or sharing your data, e.g., with third parties
We work with various service providers to create and operate the app, and to deliver the respective services. To the extent that we have engaged these service providers as data processors on our behalf to process data in accordance with our instructions, their data processing activities do not require your consent.
Service providers appointed to create and operate the app:
- Providers of hosting services
- Providers of programming services
- Providers of other services in the app
We will only share your data with other recipients if this is necessary for fulfilling a contract with you or between you and the third party, if we or the recipient have a legitimate interest in sharing your data, or if you have consented to such transmission. These recipients include service providers and other companies within our group of companies. Data may also be transmitted to other recipients if we are required to do so by law or in accordance with enforceable official or court orders.
Other recipients of your data include, in particular, service providers whose offers and services (third-party services) can be used in connection with the app or whose app facilitates access to such services.
Content, in particular recipes that you have created yourself, may also be transmitted to other BSH companies (including internationally) within the framework of the technical management and provision of the content/services. The basis for this transmission/processing are data protection agreements between the BSH companies involved, which also include the application of standard contractual clauses, provided that transmission takes place to a country outside the scope of the GDPR and does not constitute a case of Art. 45 GDPR.
6. Recording app usage
The app offers the option of collecting app-related usage data (see 1.d. above). Depending on your country of residence and your chosen operating system, consent may be required, or you may have the option to change your consent as described below. We use the following provider to collect app-related usage data:
Adobe Analytics from Adobe Systems Software Ireland Limited, 4–6 Riverwalk, Citywest Business Campus, Dublin 24, Republic of Ireland (hereinafter “Adobe”).
If “Allow data collection” is enabled, app-related usage data will be transmitted to and stored on servers of the named provider located in the EU. The app-related usage data permits analysis of your use of the app (see 1.a, b. above).
IP anonymisation has been activated for this app, meaning that your IP address will first be shortened. On behalf of Home Connect, the respective provider will use this information to evaluate your use of the app, generate error reports, and compile reports on app activity for Home Connect.
These analyses serve as a basis for improving the app itself, better understanding and improving app usage and the connection of household appliances, and for providing contextual content in the app and on websites you use. To provide contextual content, we create typical usage profiles (so-called “audiences”) that enable us to deliver such content in a way that is appropriate for you. The IP address and other personal data transmitted by your mobile device as part of the services mentioned above will not be merged with other data from the aforementioned providers or from Home Connect without your specific consent.
You can control the collection of app-related usage data (including your anonymised IP address) by the aforementioned services, as well as the processing of this data by the aforementioned services, by activating or deactivating this option in the personal settings within the app or in the corresponding system menu of your mobile device. The analysis data is assigned to a unique, pseudonymous ID that does not change even after reactivation. Depending on the legal situation in your country, the analysis function may be active by default; however, in such a case it is possible to choose the setting individually.
Error reports can be sent to us from the app, moreover, allowing us to take concrete measures to resolve such issues. These error reports are personalised for the purpose of analysing and resolving any specific issue you report. Without direct personal reference, error reports are used to resolve issues generally for all app users and, if possible, to prevent future issues.
Subject to your specific consent (e.g., consent to marketing via the website), we may also use the app-related usage data within the scope of this consent to tailor corresponding (marketing) communications to you and your interests. We will also inform you about this potential use within the scope of your consent.
7. Data security
We use technical and organisational measures, for example to protect your data from manipulation, loss, and unauthorised access by third parties. These measures include the use of encryption technologies, certificates, and firewalls on the Foodfittery servers. Our security measures are continuously reviewed and improved in line with technological developments.
8. Scope of the Data Privacy Policy
This Data Privacy Policy applies to the features and services offered by Foodfittery via the app. If additional features or services are offered within the app either by Foodfittery or a company of the BSH Group, specific information on data protection will be provided if use of these features or services is subject to special data protection provisions or information.
However, this Data Privacy Policy does not apply to third-party services, even if Foodfittery enables the use of or access to such third-party services in the app (refer also to the Terms of Use for Third-Party Services). The use of such third-party services is subject to the respective data protection provisions of the third-party provider and, if applicable, to additional data protection policies at our end that address the specifics of these third-party services and are only relevant in this context.
If you are referred to another service provider, Foodfittery will make reasonable and appropriate efforts to clarify this reference (e.g., by embedding the service provider’s content within the app using inline frames) if it is not clear. If you click on a link in the Foodfittery app that opens an app or the website of another service provider, this is considered a clear link.
If you, as a user, reside within the jurisdiction of the GDPR, please note that the use of third-party services may result in your personal data being processed in countries beyond the jurisdiction of the General Data Protection Regulation. In this case, please refer to the privacy policies of the respective third-party service providers.
9. Changes to the Date Privacy Policy
With the ongoing development of the app and the services provided through the app—including through the implementation of new technologies or the introduction of new services—this Data Privacy Policy may need to be adapted accordingly. Foodfittery reserves the right to change or supplement this information as needed. Foodfittery will continually update the Data Privacy Policy in the app; you can therefore familiarise yourself with the latest version at any time.
10. Rights and contact information
If, despite our efforts to ensure data accuracy and timeliness, incorrect information about you is stored, we will correct it at your request. If you have given us your consent to collect, process and use your personal data, you can revoke this consent at any time with future effect. You can usually revoke your consent via the respective app settings or otherwise using the contact information provided in the app.
The stored personal data will be deleted if you revoke your consent to storage, if your personal data is no longer required to fulfil the purpose for which it was stored, or if its storage is not permitted for other legal reasons. Please note that for technical or organisational reasons there may be an overlap between the revocation of your consent and the use of your data, e.g. if a newsletter has already been sent. Data that is required for billing and accounting purposes or that is subject to a statutory retention period is not affected by this. If you have any questions about data protection or wish to exercise your right to withdraw your consent or to information, correction, deletion or restriction, please contact us using the contact information provided in the app.
11. Additional information in accordance with the General Data Protection Regulation
a. Legal basis for the intended use of data
We base the following data uses on
- the performance of a contract pursuant to Article 6 (1b) GDPR:
- Provision of the app features and the services offered via the app by processing the data categories listed in points 1.a.-b.
- Transfer of the data categories listed in points 1.a.-b. to providers of third-party services that can be used in connection with the app (see point 9).
- Error correction by processing the data categories listed in points 1.a.-b.
- your consent in accordance with Article 6 (1a) GDPR:
- Direct marketing purposes through the processing of the data categories listed in points 1.a.-b.
- Improving the user-friendliness of the app by processing the data categories listed under point 2.
b. Your rights
Additional rights to those set out in Section 11 are specified below. To exercise your rights, please use the contact information provided at the end of this privacy notice.
- Your right to information about your data: We will provide you with information about the data we have stored about you upon request.
- Your right to rectification and completion of your data: We will rectify inaccurate data about you if you notify us. We will complete incomplete data if you notify us, provided that this information is necessary for the intended purpose of processing your data.
- Your right to erasure: We will delete the data we hold about you upon request. However, some data will only be deleted subject to a specific retention period—for example, because we are legally obligated to retain the data in certain cases or because we need the data to fulfil our contractual obligations to you.
- Your right to restriction of your data: In certain legally regulated cases, we will restrict the processing of your data at your request. Restricted data will only be processed to a very limited extent.
- Your right to withdraw consent: You can withdraw your consent to the processing of your data at any time with future effect. This will not affect the legality of the processing of your data until the time of withdrawal.
- Your right to object to the processing of your data: You can object to the processing of your data at any time with future effect if we process your data based on one of the justifications listed in Article 6 (1e or 1f) GDPR. In the event of your objection, we will stop processing your data unless there are compelling and legitimate reasons for further processing. Processing your data for direct marketing purposes never constitutes a compelling and legitimate reason on our part.
- Your right to data portability: At your request, we can provide you with certain information in a structured, commonly used, and machine-readable format.
- Your right to lodge a complaint with a supervisory authority: You may lodge a data protection complaint with a data protection authority. You can do so by contacting the data protection authority responsible for your place of residence or the data protection authority under whose jurisdiction we fall (referred to below).

c. Transfer to recipients outside the EEA
If necessary, we may also transfer personal data to recipients located outside the EEA, in so-called third countries, to provide app features and the services offered via the app. In this case, before transferring the data, we ensure that either an appropriate level of data protection is maintained by the recipient (e.g., based on an adequacy decision of the EU Commission for the respective country or the agreement of EU standard contractual clauses between the European Union and the recipient) or that you have consented to the transfer.
We will be happy to provide you with an overview of the recipients in third countries and a copy of the specific provisions agreed to ensure an adequate level of data protection. Please use the contact information at the end of this privacy policy.
